Las Vegas Probate AttorneyProbate is a legal proceeding in which the court has jurisdiction to administer and distribute the assets of a decedent to those entitled to them, including heirs, creditors and others. For instance, if the value of the assets is $20,000 or less, and there are no real property assets, a simple Affidavit of Small Estate may be used to close the probate matter. If the value of estate assets is between $20,000 and $100,000, a set-aside proceeding may be used. For estates valued in excess of $100,000 but less than $200,000, a Summary Administration is the proceeding to be followed. Summary probate proceedings require a 60-day notice to creditors. For estates whose assets are greater than $200,000, a General Administration is required. Probate of such estates is more complex and requires significant time and expense. General Administration probate requires a 90-day notice to creditors. Not all assets of a decedent's estate must go through probate, and Gary G.
